Bergman’s book is a very handy reference for law students and beginning lawyers. The book discusses many of the skills needed for the courtroom in a clear and concise manner (true to its title). The book emphasizes the importance of telling the jurors a story at trial instead of just reciting facts. There is a lot of practical advice as well. Bergman explains that in opening statements, lawyers do not need to repeatedly say, “the evidence will show” throughout the opening. Unfortunately, too many lawyers still do this.
Bergman is an expert at breaking complicated subjects into understandable parts. One such example is cross-examination. For example, in deciding which questions to ask so that you can be assured of getting the answer you want, he instructs lawyers to think about which questions are highly safe, minimally safe, and marginally safe. Bergman then explains how and why to do this. This book has a lot of wisdom in it and is the perfect complement for any trial advocacy textbook.
